Brigham Hill III Permit Extension Discussion
The Board is in receipt of a letter dated October 3, 2013 from Atty. Michael Norris requesting an extension of time to complete the Brigham Hill III subdivision as he believes it falls under the Permit Extension Act of 2010. After seeking a legal opinion from Town Counsel in which he states that the Board must approve an extension the Board agrees to grant an extension to expire on November 30, 2015. The Board noted that this will extend the period to complete the subdivision to nine years.
The Board unanimously agreed that no more extensions will be granted.
David Daigneault, seconded by Dirk Underwood, made a motion to grant an extension to complete the Brigham Hill III Subdivision until November 30, 2015 under the Massachusetts Permit Extension Act with the following conditions:
- The Developer will appear before the Board on June 2, 2015 to assure the Board that the subdivision will be completed by the expiration date.
- No other extensions will be granted.
Vote: 4-0-0, Unanimous.
